Fighting for Iowans After On-the-Job Injuries

5/5

The team at RSH Legal has been tremendously helpful in navigating the world of injury and workers’ compensation. It has been a long, tough journey. I greatly appreciate their professionalism and help.

Your Main Job Is to Recover

Getting workers’ compensation is not always straightforward. We make sure you are treated fairly and receive the benefits you have earned. We handle the paperwork and the insurance company while you focus on treatment and getting back to the work you do best.

You’re not hiring one lawyer, you’re hiring an entire team.

You have just 90 days to report your work injury to your employer in order to stay eligible for benefits. You do not have to face this alone. We are here 24/7, whenever you need us.

Our Job Is to Maximize Your Compensation

Most people do not know where to start when seeking workers’ compensation. Even if you do everything right, you can still be denied benefits, or the insurance company may claim your injury is not work-related. The workers’ compensation attorneys at RSH Legal stand with Iowans who just want what is fair after a work injury.

Get Straight Answers to Your Iowa Workers’ Compensation Questions

Typically, workers’ compensation benefits apply when an injury occurs during work-related activities. This applies to those who:

  • Sustained an on-the-job injury while working in Iowa
  • Regularly performed work duties in Iowa
  • Were hired in Iowa

It doesn’t matter if you were partly at fault for the work injury. The workers’ compensation system in Iowa operates on a no-fault basis. That means individuals are eligible for workers’ compensation regardless of fault unless the injury was intentionally self-inflicted.

This depends on multiple factors specific to your case. Here are the five key factors that determine the value of a workers’ compensation settlement.

  • The Location and Classification of Your Injury: The location of your injury can mean tens of thousands of dollars more in settlement value. For scheduled member injuries (e.g., hands, eyes, legs), you’ll be paid based on a doctor’s impairment rating. For body as a whole injuries (e.g., torso, neck, head), you’ll be paid based on your loss of earning capacity.
  • Your Weekly Benefit Rate: Your weekly benefit rate is approximately 80% of your weekly take-home earnings after taxes at the time of your injury, including overtime. This calculation forms the foundation for everything you’ll receive. Even a small, $50-per-week error by insurance companies can mean thousands of dollars less over the life of your claim.
  • Your Medical Expenses and Future Treatment Needs: Your workers’ comp settlement must cover past and future medical treatment related to your work injury. This includes ER visits, hospital stays, surgeries, doctor visits, physical therapy, medications, and necessary medical equipment.
  • Your Lost Earning Capacity: Loss of earning capacity considers your earnings before and after your work injury. Other factors that are considered include your age, education, work history, qualifications, and your ability to compete for other jobs. Many judges who decide workers’ compensation cases will also consider your motivation to find work if you lose your job due to a work injury.
  • Additional Benefits You May Be Entitled To: You may also be entitled to mileage reimbursement for medical appointments, interest on delayed benefit payments, second injury fund benefits, temporary disability benefits, and permanent disability benefits.

Iowa law requires workers’ compensation insurance companies to pay for all reasonable and necessary medical treatment connected with a work-related injury. This means all past and future medical needs, such as ongoing care. Many injured workers do not realize this, and it can cost them thousands.

Insurance companies sometimes shift medical costs to your health insurance. When this happens, you may be forced to cover co-pays and deductibles out of pocket. These medical expenses should never have been your responsibility as an injured worker.

In addition, if you do receive a workers’ compensation settlement and your health insurance paid any medical bills related to your work injury, your health insurance company may seek reimbursement from your workers’ comp settlement.

Initially, no. It is important to attend any and all appointments with the doctor chosen by your employer’s workers’ compensation insurance company. This helps guarantee payment for your work-related medical costs.

Seeking medical treatment from your own healthcare provider without clearance from the workers’ compensation insurance company could mean that they won’t have to pay for your medical expenses.

The situation changes if your workers’ compensation claim is formally rejected in writing by the insurance company. At this point, you are then permitted and advised to seek treatment from your own medical provider.

In Iowa, every injured employee is entitled by law to file a workers’ compensation claim.

If a worker gets fired because they filed for workers’ compensation benefits, they can file a wrongful termination lawsuit against their employer for violating Iowa law.

We Guide You, Every Step

RSH Legal has spent decades working for Iowans who’ve been hurt on the job. We know that a major injury or illness can leave you stressed and uncertain. You deserve fairness, and our lawyers can provide a guiding hand with the workers’ comp process.

Our lawyers bring decades of experience to Iowa work injury cases. We guide you through the workers’ compensation process and look for a third-party claim whenever someone other than your employer caused your injury, because that can open up compensation workers’ comp does not cover. We answer your questions in plain language, so you always know where your case stands.

RSH Legal is ready to stand up for hard-working Iowans whenever they feel pushed around. Our attorneys know how complicated the workers’ compensation system can be. It is not as simple as many workers believe, and we push back on your behalf when the insurance company denies, or delays benefits you have earned.

RSH Legal has a record of notable case results, including a $9 million recovery for an ironworker struck by a falling jackhammer, a $1.8 million verdict for a worker injured at the UNI-Dome after a concert, and a $388,000 settlement for a worker with a severely injured neck.

RSH Legal has law offices in Des Moines, Cedar Rapids, and Dubuque. Our work injury attorneys can assist Iowans after on-the-job accidents in every county in Iowa.

Some workers avoid speaking with lawyers because they worry about the cost. At RSH Legal, we offer free and confidential consultations. Think of it as a legal strategy session: you speak with an attorney about what happened, learn your options, and leave knowing your next step, at no cost and no obligation.

RSH Legal works on a contingency fee basis. That means you pay nothing upfront. Clients only pay legal fees if we secure a workers’ compensation settlement or win damages in court. If we do not win, you do not pay.

Compensation After a Workplace Accident in Iowa

The value of a workers’ comp claim depends on whether you have a scheduled member injury or a body as a whole injury. You can also file a third-party claim if someone other than your employer or a co-worker caused your injuries. Third-party claims let you seek compensation for pain and suffering and other damages not covered by workers’ comp.

RSH Legal will look at your current expenses and your loss of income. We will also consider your condition, its future impact on your life, and whether a separate third-party claim could increase what you recover.

Workers’ compensation often falls short of covering the full scope of a workplace accident. A third-party claim can help you recover what workers’ compensation does not after an on-the-job injury.
